Terms of Service

The rules and conditions that govern your use of Chicco.

1. Acceptance of Terms

By downloading, installing, or using the Chicco mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notification or email. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

  • You must be at least 13 years old to use Chicco.
  • You must have the legal capacity to enter into a binding agreement in your jurisdiction.
  • If you are using the App on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Account Registration

To access most features of Chicco, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials and not share your password.
  • Notify us immediately of any unauthorized use of your account.
  • Be responsible for all activity that occurs under your account.

We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Use of the App

4.1 Permitted Use

You may use the App solely for its intended purpose — browsing menus, placing orders, tracking deliveries, and managing your account — in accordance with these Terms and all applicable laws.

4.2 Prohibited Conduct

You agree not to:

  • Use the App for any unlawful or fraudulent purpose.
  • Attempt to reverse engineer, decompile, or disassemble the App.
  • Scrape, crawl, or harvest data from the App without written permission.
  • Introduce malware, viruses, or other harmful code.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Interfere with or disrupt the App's servers, networks, or services.
  • Use automated scripts or bots to interact with the App.
  • Submit false, misleading, or abusive content, reviews, or orders.

5. Orders and Payments

5.1 Order Placement

When you place an order through the App, you are making an offer to purchase. Orders are confirmed once you receive an in-app confirmation. We reserve the right to refuse or cancel any order at our discretion.

5.2 Pricing

All prices are displayed in the local currency and are subject to change without notice. The price shown at checkout is the final price. Taxes and delivery fees (where applicable) are displayed before payment.

5.3 Payment

By providing payment information, you represent that you are authorized to use the payment method. All transactions are processed through secure, third-party payment processors. We are not responsible for errors made by payment processors.

5.4 Cancellations and Refunds

  • Orders may be cancelled within 2 minutes of placement at no charge.
  • After preparation has begun, cancellations are at the discretion of the branch.
  • Refunds for defective or incorrect orders will be issued to your original payment method or as store credit within 5–10 business days.
  • Delivery fees are non-refundable once a delivery has been dispatched.

6. Loyalty Points and Rewards

  • Points are earned on eligible purchases and credited after order completion.
  • Points have no monetary value and cannot be exchanged for cash.
  • We reserve the right to modify, suspend, or terminate the loyalty program at any time with reasonable notice.
  • Points expire after 12 months of account inactivity.
  • Points earned through fraudulent activity will be forfeited and the account may be suspended.

7. User Content

If you submit reviews, photos, or other content ("User Content") through the App, you grant Chicco a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display that content in connection with our services.

You represent that your User Content does not infringe any third-party rights and complies with all applicable laws. We reserve the right to remove any User Content that violates these Terms.

8. Intellectual Property

The App and all its content — including but not limited to text, graphics, logos, icons, images, audio clips, and software — are the property of Chicco or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

9. Third-Party Services

The App may integrate with or link to third-party services (e.g., Google Maps, payment processors, social login providers). These third parties are governed by their own terms and privacy policies. We are not responsible for the content, practices, or policies of third-party services.

10. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

  • The App will be uninterrupted, error-free, or secure.
  • Defects will be corrected.
  • The App or the servers that make it available are free of viruses or other harmful components.

To the fullest extent permitted by law, Chicco disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Chicco and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Chicco and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall first be addressed through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or the competent courts of the applicable jurisdiction.

14. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including payment obligations, intellectual property rights, disclaimers, and limitations of liability) will continue to apply.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable. The remaining provisions will continue in full force and effect.
